TERMS AND CONDITIONS OF USE FOR THE “MERRY30” PROMOTION for Clients of MY FUNDING ACCOUNT PSA

§ 1 General Resolutions

1.       These Terms of Use (hereinafter referred to as the “Terms”) define the terms and conditions of the promotion (hereinafter referred to as the “Promotion”) under the name: MERRY30.

2.       The organizer of the Promotion is My Funding Account Prosta Spółka Akcyjna with its registered office in Katowice at Aleja Korfantego 138A, 40-156 Katowice, entered into the Register of Entrepreneurs of the National Court Register by the District Court Katowice-Wschód, 8th Commercial Division of the National Court Register under the KRS number: 0001023771, tax identification number NIP: 6343021306, hereinafter referred to as “MFA.”

3.       The Promotion is valid from December 12, 2024, to December 27, 2024 (the duration of the Promotion).

4.       The Promotion “MERRY30” is conducted on the MFA website, available at https://myfundingaccount.com/ (hereinafter referred to as the “Promotional Website”).

5.       The “MERRY30” Promotion applies to the following products listed on the Promotional Website (hereinafter referred to as the “Promotional Products”):

§ 2 Conditions of Participation in the Promotion

1.              The Promotion is open to individuals who are of legal age and have full legal capacity, who during the Promotion period make a purchase on the website https://myfundingaccount.com/ in accordance with the provisions of   § 3 below.

2.               Orders placed before or after the Promotion period shall not qualify for the “MERRY30” Promotion, and the prices of products shall be standard, excluding the terms of these Regulations, particularly § 3 below.

3.              Completing a purchase on the Promotional Website during the Promotion period and in accordance with § 3 below constitutes acceptance of these Regulations and consent to the processing of personal data by the Organizer under the terms of these Regulations.

4.              Participation in the Promotion is free and voluntary.

5.              All Participants of the Promotion must adhere to and respect the Terms&Conditions of MFA and any other regulations made available on https://myfundingaccount.com/.

6.              A participant may take part in the Promotion multiple times during its duration, provided that the conditions specified in the Regulations are met for each instance.

§ 3 Rules of the Promotion

1.              Products included in the “MERRY30” Promotion and available on the Promotional Website will be offered at a discounted price starting December 12, 2024. The discount applied to the products in the “MERRY30” Promotion will be 30% off the regular retail price indicated on the Promotional Website. The discount granted under the Promotion is not exchangeable for cash equivalents, and participation in the Promotion is voluntary.

2.              MFA reserves the right to individually decide on the selection and quantity of products included in the “MERRY30” Promotion, as well as the percentage discount applied to the respective products within the Promotion, in compliance with these Regulations.

3.              The “MERRY30” Promotion cannot be combined with other promotions (including discounts). In the event of other concurrent promotions (including discounts), a Participant in the “MERRY30” Promotion has the right to choose whether to benefit from the “MERRY30” Promotion or another promotion.

4.              To participate in the “MERRY30” Promotion, the participant must click the “START” button for the selected product on the Promotional Website, complete all required fields in the order form, including entering the “MERRY30” discount code in the “DISCOUNT CODE” field, and make a payment for the amount displayed in the order form after applying the 30% discount. Any person who completes all the aforementioned steps shall be deemed a Participant of the “MERRY30” Promotion.

5.              In addition to the 30% discount, participants in the Promotion may also qualify for an additional bonus in the form of free access to a Challenge Account (hereinafter referred to as the “Bonus Products”), in accordance with the provisions of § 4 below.

6.              Participants of the Promotion who are registered on the Organizer’s trading platform at https://platform.myfundingaccount.com/login (hereinafter referred to as the “Platform”) shall receive access to the purchased Promotional Product within a maximum of 72 hours from the time the payment is credited to MFA. For participants not registered on the aforementioned website at the time of placing the order, access will be granted within 96 hours from the time the payment is credited to MFA and the participant registers on the Platform, whichever occurs later.

7.              Products covered by the “MERRY30” Promotion are subject to the standard rules for complaints and returns, as outlined in the Terms of Service available on the homepage https://myfundingaccount.com/, unless otherwise stated in the Regulations.

8.              MFA declares that the right of withdrawal from agreements concluded outside the business premises or at a distance does not apply to the purchase of services where the Participant has explicitly agreed to the full performance of the service before the withdrawal period expires, has been informed of this, and has acknowledged the loss of the right to withdraw from the agreement.

9.              Participants are entitled to submit complaints regarding non-compliance of the Promotion with these Regulations. Complaints must be sent to the email address: contact@myfundingaccount.com and should include a detailed description of the complaint, the Participant’s name, and contact information, including their email address. Complaints will be addressed by MFA within 14 days of receipt. Participants will receive a response to their complaints at the email address they provided.

§ 4 Bonus Products

1.              Participants who meet all the conditions of the Promotion as specified in §§ 2 and 3 of these Regulations shall receive free access to the Bonus Products in the form of a Challenge Account, as outlined below:

2.              Bonus Products are granted for purchases made in accordance with these Regulations and for any Challenge type (Standard, Plus, Wanted) with a minimum account size of 62,500 USD (62.5k).

3.              Promotional participants registered on the Organizer’s trading platform available at https://platform.myfundingaccount.com/login receive access to the bonus product covered by the „MERRY30” promotion up to a maximum of 72 hours from the moment the funds are credited by the MFA after placing the order. However, in the case of Promotion Participants who were not registered on the above-mentioned website at the time of placing the order, the following, the deadline for receiving access is set at a maximum of 96 hours from the moment the funds are credited by the MFA and registered on the above-mentioned page, depending on which event occurs later.

§ 5

Personal Data Processing and Protection

1.      Personal data of Participants will be processed by the Organizer.

2.      Providing data is voluntary, but it is necessary for the full and correct implementation by the Organizer of activities in connection with which Participants provide their personal data. Failure to provide data prevents participation in the Competition.

3.      The processing of personal data of Participants by the Organizer is lawful because it is necessary for the Organizer to carry out activities for Participants in connection with which Participants provide their personal data (i.e. exercise of rights and obligations arising from the Competition Regulations) and for purposes arising from legitimate interests pursued by the Organizer, including: handling complaints in the field of GDPR, processing for analytical and statistical purposes. The legal basis for the processing of your personal data is, as appropriate, Article 6, paragraph 1, b or f of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (general data protection regulation) – referred to as „RODO”.

4.      Personal data of Participants will be processed for the period of implementation by the Organizer of activities in connection with which they shared their personal data, the period of consideration of complaints regarding these activities, and, until the expiry of the limitation period for claims related to these activities, and in the scope of data processing for marketing, analytical and statistical purposes – until the Participant objects to the processing of data for these purposes.

5.      Participants have the right to access their personal data, the right to rectify them, delete or limit processing and the right to transfer data. Participants also have the right to object at any time to the processing of their data for marketing, statistical and analytical purposes.

6.      Participants have the right to lodge a complaint in connection with the processing of data carried out by the Organizer to the body supervising the protection of personal data in Poland – to the President of the Office for Personal Data Protection.

8.      By entering the Competition, the participant gives permission for their image and voice to be recorded and used in photo, audio, and video materials for promotional purposes of the Competition, without any time limits or territorial restrictions, and without any compensation..

§ 6 Final Provisions

1.       The Organizer is not responsible for the inability of the Customer to use from promotion.

2.       The Organizer reserves the right to change these Regulations at any time.

3.       The amendment to these Regulations will enter into force at the time of its announcement on the Organizer’s website, in such a way that the Participants have the opportunity to familiarize themselves with it.

4.       The Organizer reserves the right to cancel or postpone the Promotion without giving a reason. Participants of the Promotion hereby waive any claims against the Organizers in this respect. In the event of cancellation of the Promotion, the Organizer will refund the Participants fees in the same form in which they were paid to the Organizer.

5.       Participants of the Promotion shall bear all liability for damage caused by them to the Organizer or a third party in connection with participation in the Promotion.

6.       In matters not covered by these regulations, the provisions of the Civil Code (Dz. U. 2023.1610) of the act of 30 May 2014. (Dz.U.2020.287 i.e.) on consumer rights and other generally applicable legal acts.

7.       In the event of a contradiction of the provisions of these Regulations with any other document made available on the https://myfundingaccount.com website, the provisions of the Regulations shall prevail as part of participation in this Promotion.

9.       These regulations come into force on 12.12.2024.
